Las denuncias por responsabilidad médica en Ecuador se incrementaron en la última década a raíz de la penalización de la mala práctica profesional establecida en el Código Orgánico Integral Penal; la investigación es compleja y el peritaje médico legal se convierte en una pieza fundamental en el conflicto. Aquí analizamos 10 informes periciales de casos de mala práctica médica en Ecuador, se analiza la legislación ecuatoriana y revisión de la literatura referente al tema. Se identificó la falta de protocolos o (...) guías de procedimientos, los informes no cuentan con estructura y es el resultado de la discrecionalidad del perito designado. Se propone un protocolo de actuación pericial que facilitará la actividad del perito y mayor objetividad en la investigación. (shrink)

Resumen El análisis del poema Caperucita Roja resulta atractivo por sí mismo, ya que su factura corrobora las cualidades inigualables de la poeta Gabriela Mistral. Sin embargo, el hecho de que sea reescritura de un cuento que remonta sus orígenes al folklore europeo y que sea mundialmente conocido por medio de sus versiones modernas desde un punto de vista infantil: Perrault y los hermanos Grimm, vuelve la obra una curiosidad. El propósito del análisis es describir la dimensión erótica del sistema (...) de recursos lingüístico-discursivos usados por Mistral para recrear la historia y refundar el sentido del texto original, quizá recuperando la lectura del crimen, la inocencia ultrajada y el dolor que aquel ofrecía. Abstract The analysis of Gabriela Mistral´s poem Little Red Riding Hood is appealing since its composition confirms the insuperable quality of the author´s poetic work. However, the fact that the story finds its origins in the European folklore and that it became known worldwide due to its modern versions (Perrault and the Brothers Grimm), turn the poem into a curiosity. The purpose of the analysis is to describe of the erotic dimension of the linguistic discursive resources used by Mistral to recreate the story and restore the meaning of the original text, probably recovering its reading as crime, shattered innocence, and the pain that it conveyed. El estudio propuesto intenta ofrecer una entrada parcial pero ilustrativa del fenómeno de canonización de la figura autorial de Roberto Bolaño y su obra, desde una perspectiva sistémica, valorativa y diacrónica. El supuesto básico de este trabajo es que la lengua es un sistema social y una red de recursos de construcción de significado que se instancia a través de múltiples textos, surgidos según condiciones contextuales determinadas, orientados a la consecución de metas específicas y constreñidos por valores y reglas institucionales (...) que determinan su funcionamiento, orientación, circulación y predominancia. Se utiliza el enfoque lingüístico sistémico-funcional como marco teórico y se recurre a algunas de sus herramientas analíticas para explicar los significados interpersonales cristalizados en un texto crítico literario que sirve de ejemplo del tipo de discursos integrantes del proceso dinámico y conflictivo de formación de cánones literarios. El análisis demuestra que el texto presenta un compromiso mayoritariamente heteroglósico, pero realizado a través de uno de sus mecanismos menos explícitos y democráticos: la legislación. (shrink)

Long noncoding RNAs have been described in cell lines and various whole tissues, but lncRNA analysis of development in vivo is limited. Here, we comprehensively analyze lncRNA expression for the adult mouse subventricular zone neural stem cell lineage. We utilize complementary genome-wide techniques including RNA-seq, RNA CaptureSeq, and ChIP-seq to associate specific lncRNAs with neural cell types, developmental processes, and human disease states. By integrating data from chromatin state maps, custom microarrays, and FACS purification of the subventricular zone lineage, we (...) stringently identify lncRNAs with potential roles in adult neurogenesis. shRNA-mediated knockdown of two such lncRNAs, Six3os and Dlx1as, indicate roles for lncRNAs in the glial-neuronal lineage specification of multipotent adult stem cells. Our data and workflow thus provide a uniquely coherent in vivo lncRNA analysis and form the foundation of a user-friendly online resource for the study of lncRNAs in development and disease. © 2013 Elsevier Inc. Job motivation remains an area of concern among researchers due to the rising issues of poor or lack of motivation among workers. This refers to one’s personal will or drives to perform a task at work. Meanwhile, job satisfaction refers to an employee’s sense of fulfillment with his or her work experience. Therefore, the current study utilized the descriptive- correlational research design to investigate the impact of job motivation on the job satisfaction of accountants. To gather essential data and achieve (...) the objectives of the study, Multidimensional Work Motivational Scale (MWMS) and Minnesota Satisfaction Questionnaire (MSQ) were administered to the target respondents. The collected data were then analyzed using a Multiple Regression Analysis; findings revealed that job motivation has a significant impact on the job satisfaction of accountants. Additionally, the results of this study were carefully evaluated and discussed, and recommendations were made to benefit the stakeholders of the study and contribute to the existing body of knowledge. Dos místicos relativamente contemporáneos: Etty Hillesum y Benjamín González Buelta; dos estilos, dos contextos y una coincidencia establecida desde sus experiencias espirituales, en profunda conexión con la realidad, en medio de la vida y sus desafíos. Hillesum no habla propiamente de la experiencia mística, sin embargo, su proceso personal existencial en el duro contexto de guerra que le tocó vivir, la condujo a descubrirse profundamente habitada. Su experiencia de Dios le hizo posible comprender y gestionar el dolor en medio de (...) la guerra, así como la necesidad de ‘hacerse bálsamo sobre las heridas’ de sus hermanos judíos. Etty es una mística de ojos abiertos. Benjamín González Buelta ha profundizado en la comprensión de la mística, describiéndola y analizándola desde la experiencia de Dios en el contexto latinoamericano. Su reflexión permite hoy leer a Etty Hillesum desde la perspectiva del místico de ojos abiertos. (shrink)

Wilson expands Russell’s well-known acknowledgement of Peano’s influence on his own development, seeing in Peano’s logic more than a new “mathematical tool”, describing Peano as a kind of proto-logicist, and defending him from Poincaré’s criticisms. What does woman mean? According to two competing views, it can be seen as a sex term or as a gender term. Recently, Jennifer Saul has put forward a contextualist view, according to which woman can have different meanings in different contexts. The main motivation for this view seems to involve moral and political considerations, namely, that this view can do justice to the claims of trans women. Unfortunately, Saul argues, on further reflection the contextualist view fails to do justice (...) to those moral and political claims that motivated the view in the first place. In this article I argue that there is a version of the contextualist view that can indeed capture those moral and political aims, and in addition, I use this case to illustrate an important and more general claim, namely, that moral and political considerations can be relevant to the descriptive project of finding out what certain politically significant terms actually mean. Sociologists often ask why particular groups of people have the moral views that they do. I argue that sociology’s empirical research on morality relies, implicitly or explicitly, on unsophisticated and even obsolete ethical theories, and thus is based on inadequate conceptions of the ontology, epistemology, and semantics of morality. In this article I address the two main problems in the sociology of morality: (1) the problem of moral truth, and (2) the problem of value freedom. I identify two ideal–typical approaches. (...) While the Weberian paradigm rejects the concept of moral truth, the Durkheimian paradigm accepts it. By contrast, I argue that sociology should be metaphysically agnostic, yet in practice it should proceed as though there were no moral truths. The Weberians claim that the sociology of morality can and should be value free; the Durkheimians claim that it cannot and it should not. My argument is that, while it is true that factual statements presuppose value judgments, it does not follow that sociologists are moral philosophers in disguise. Finally, I contend that in order for sociology to improve its understanding of morality, better conceptual, epistemological, and methodological foundations are needed. (shrink)

The history of the field of business ethics in the U.S. remains understudied and misunderstood. In this article I begin to remedy this oversight about the past, and I suggest how it can be beneficial in the present. Using both published and unpublished primary sources, I argue that the business ethics field emerged in the early twentieth century, against the backdrop of the establishment of business schools in major universities. I bring to light four important developments: business ethics lectures at (...) the University of California and Yale University, Leon Marshall’s curriculum at the College of Commerce of the University of Chicago, and the William A. Vawter Foundation on Business Ethics at Northwestern University. Then, I consider the payoffs of my historical account for business ethics theory, pedagogy, and practice. Specifically, I present four implications of my account under these headings: business ethics as a public problem; the place of ethics in business schools; historicizing business ethics; and historical self-knowledge. Concepts of decision, choice, decision-maker, and decision-making are common practical tools in both social science and natural science, on which scientific knowledge, policy implications, and moral recommendations are based. In this article I address three questions. First, I look into how present-day social scientists and natural scientists use decision/choice concepts. What are they used for? Second, scientists may differ in the application of decision/choice to X, and they may explicitly disagree about the applicability of decision/choice to X. Where exactly do (...) these disagreements lie? Third, I ask how scientists should use decision/choice concepts. What are they correctly and incorrectly used for? I argue that scientists must responsibly attend to a methodological demand: you have to have a principled, non-ad hoc, well-argued-for way of telling where decision/choice applicability ends. Thus, I aim to minimize the risk of conceptual stretching and foster responsible conceptual practices in a large body of scientific work. (shrink)

Sociological propositions about the workings of cognition are rarely specified or tested, but are of central relevance to studies of culture, social judgment, and social movements. This paper draws out lessons of recent work from sociological theory, cognitive science, psychology, and neuroscience on the embodied nature of knowledge and thought, and develops implications of these lessons for cultural and cognitive sociology. Knowledge ought to be conceived of as fundamentally embodied, because sensory information is a fundamental component of experience as it (...) is stored in long-term memory, and because bodily responses and intuitions often precede reflexive or strategic thought. I argue that the challenge of embodied knowledge for cultural sociology is threefold: to develop cultural theories of motivation; to specify the ways in which the body structures discourses endogenously; and to specify how embodied motivations and embodied discourses interact. Durkheim's underdeveloped notion of fatalism is the keystone for a bridge between two conceptual categories central to Marxian and Durkheimian theory: alienation and anomie. Durkheim does not necessarily disagree with Marx that excessive regulation can be socially damaging but chooses to highlight the effects of under-regulation. A Durkheimian critique of overregulation becomes possible if we turn away from anomie and toward Durkheim's idea of fatalism—a concept that I will argue here is unexpectedly consistent with Marx's notion of alienation. We can (...) infer that Durkheim presents us with a notion of an “optimal” human condition that exists between anomie and fatalism. The structure of modern societies, it will be argued, is characterized not just by excessive control leading to alienation or by a lack of integrative restraint leading to anomie but also by active efforts to optimally regulate social life. Hubert Dreyfus has defended a novel view of agency, most notably in his debate with John McDowell. Dreyfus argues that expert actions are primarily unreflective and do not involve conceptual activity. In unreflective action, embodied know-how plays the role reflection and conceptuality play in the actions of novices. Dreyfus employs two arguments to support his conclusion: the argument from speed and the phenomenological argument. I argue that Dreyfus's argumentative strategies are not successful, since he relies on a dubious assumption about (...) concepts and reflection. I suggest that Dreyfus is committed to a minimal view of conceptuality in action. (shrink)

Margarita Diaz-Andreu offers an innovative history of archaeology during the nineteenth century, encompassing all its fields from the origins of humanity to the medieval period, and all areas of the world. The development of archaeology is placed within the framework of contemporary political events, with a particular focus upon the ideologies of nationalism and imperialism. Diaz-Andreu examines a wide range of issues, including the creation of institutions, the conversion of the study of antiquities into a profession, public memory, changes in (...) archaeological thought and practice, and the effect on archaeology of racism, religion, the belief in progress, hegemony, and resistance. Two semantic theories of proper names are explained and assessed. The theories are Burge’s treatment of proper names as complex demonstratives and Larson and Segal’s quasi-descriptivist account of names. The two theories are evaluated for empirical plausibility. Data from deficits, processing models, developmental studies and syntax are all discussed. It is concluded that neither theory is fully confirmed or refuted by the data, but that Larson and Segal’s theory has more empirical plausibility.

Multiple studies show that periodic reanalysis of genomic test results held by clinical laboratories delivers significant increases in overall diagnostic yield. However, while there is a widespread consensus that implementing routine reanalysis procedures is highly desirable, there is an equally widespread understanding that routine reanalysis of individual patient results is not presently feasible to perform for all patients. Instead, researchers, geneticists and ethicists are beginning to turn their attention to one part of reanalysis—reinterpretation of previously classified variants—as a means of (...) achieving similar ends to large-scale individual reanalysis but in a more sustainable manner. This has led some to ask whether the responsible implementation of genomics in healthcare requires that diagnostic laboratories routinely reinterpret their genomic variant classifications and reissue patient reports in the case of materially relevant changes. In this paper, we set out the nature and scope of any such obligation, and analyse some of the main ethical considerations pertaining to a putative duty to reinterpret. We discern and assess three potential outcomes of reinterpretation—upgrades, downgrades and regrades—in light of ongoing duties of care, systemic error risks and diagnostic equity. We argue against the existence of any general duty to reinterpret genomic variant classifications, yet we contend that a suitably restricted duty to reinterpret ought to be recognised, and that the responsible implementation of genomics into healthcare must take this into account. Part I of Frege’s Grundgesetze is devoted to the “exposition [Darlegung]” of his formal system.

In this paper we look at business ethics from a deontological perspective. We address the theory of ethical decision-making and deontological ethics for business executives and explore the concept of “moral duty” as transcending mere gain and profit maximization. Two real-world cases that focus on accounting fraud as the ethical conception. Through these cases, we show that while accounting fraud – from a consequentialist perspective – may appear to provide a quick solution to a pressing problem, longer term effects of (...) fraud and misconduct make ethical implications more apparent. Widely used compensation schemes also may have the tendency to fuel unethical behavior. We argue that an ethical reinvigoration of the business world can only be accomplished by encouraging the business realm to impose upon itself some measure of self-regulating along the lines of deontological ethics. Principles of deontology should guide executive decision-making particularly when executives are tempted to operate outside of codified legislation or are bound to act under judicial-free conditions. Behaviorism is consistent with the assumptions of perfect competition, with the homo economicus model, and with a form of ethics that enshrines market-based notions of utility, justice, and rights and encourages rational maximizing. Economics and business courses foster this deficient form of ethics, assuming an overriding desire for money, which, according to MacIntyre and Aristotle, crowds out the associative virtues. These beliefs, often associated with Taylor and Friedman, lead to such practices as incentive compensation, which would be effective only if (...) employees were homines economici and thus rational in the sense of knowing how to satisfy whatever desires they have. Against Davidson’s view that psychology cannot be a natural science, Aristotle believes that there can be a teleological, if not exact, science of behavior. Aristotle believes that emotions and objectives may be rational or irrational. But rationality—phronesis, practical wisdom—is not a matter of applying algorithms. Doris questions whether character generates the first premises of an agent’s practical syllogisms, while Haidt has argued that we often act on emotions rather than on the basis of the reasons that we claim motivate us. Aristotle agrees that many people are not virtuous and that weakness of the will is a common occurrence, and he agrees that emotion drives actions. But if you are virtuous, your emotions and desires support your rationality. Aristotle gives us reason to reject the notion that people are homines economici and to treat them as rational deliberators, in part by creating an appropriate culture. The claim that it is in the nature of human beings to deliberate rationally is in part aspirational, but also in part scientific—in Aristotle’s modest sense. (shrink)

We analyze the geometric foundations of classical Yang-Mills theory by studying the relationships between internal relativity, locality, global/local invariance, and background independence. We argue that internal relativity and background independence are the two independent defining principles of Yang-Mills theory. We show that local gauge invariance -heuristically implemented by means of the gauge argument- is a direct consequence of internal relativity. Finally, we analyze the conceptual meaning of BRST symmetry in terms of the invariance of the gauge fixed theory under general (...) local gauge transformations. (shrink)

En el presente artículo se analiza la visión de Leocata sobre el cogito cartesiano. Se destaca su lectura del sum desde el acto de ser del creacionismo de Santo Tomás y su mayor evidencia para el intelecto humano, al mismo tiempo que una nueva versión de la “idea de ser infinito” que lleva a una nueva reconsideración del argumento ontológico de Descartes. Se concluye con un llamado al debate sobre esta relectura.

Ranging from behavioral to molecular levels of analysis, this informative study presents the results of recent research into the biochemistry and neural mechanisms of imprinting. Horn discusses some of the difficulties that researchers have encountered in analyzing the neural basis of memory and describes ways in which these difficulties have been overcome through the analysis of memories underlying habituation and imprinting. This paper discusses citizenship in Finnish religious education in relation to human security. It traces the characteristics of human security that connect citizenship, religion, and education in Finnish policy documents. The article focuses on basic education. Its data were analyzed employing qualitative content analysis. The findings indicate that citizenship in Finnish RE entails personal security concerns dealing with psychological and human rights issues. These are found to be essentially human security as conceptualized by the United Nations. However, Finnish policy documents (...) sparingly utilize human security in explicit terms. Finland rather emphasizes the practical applications of human security. Incorporation of explicit global citizen and human rights issues into RE in the new Finnish curriculum seems to project critical global citizenship. This is found to promote human security. Following Finland’s bid for practical application of human security, we recommend that human security be explicitly integrated into the Finnish RE curriculum. (shrink)

En este artículo analizo algunos aspectos claves del desarrollo y la evolución de las musicalizaciones de textos poéticos en Chile y profundizo en su relación con el canon literario. El análisis lo realizo tomando como referencia tres producciones de relevancia en el escenario músico-poético chileno: la musicalización del poema Alturas de Macchu Picchu de Pablo Neruda por Los Jaivas (1981), el disco Desiertos de amor (2011) de Raúl Zurita junto al grupo González y Los Asistentes, y la musicalización de poemas (...) de Elicura Chihuailaf por el grupo Kalfu en su disco Trawvn = ReUnión (2017). En términos generales, el estudio propone que las musicalizaciones de poesía constituyen un aporte a los estudios literarios, ya que permiten ampliar las perspectivas de análisis más allá de lo textual, lo que ropicia un entendimiento más profundo de las particularidades de la producción poética. Este artículo1 explora dos obras cinematográficas guatemaltecas, Polvo (2012) y Nuestras madres (2019), dirigidas por Julio Hernández Cordón y César Díaz correspondientemente. En ambos largometrajes la denuncia sobre la violación de derechos humanos durante el pasado conflicto armado guatemalteco, la búsqueda de padres o familiares desaparecidos y sus secuelas en las víctimas constituyen la temática central. Por tanto, el análisis se centra en la importancia que tiene la búsqueda del padre desaparecido en los hijos, quienes, a raíz de esta (...) vivencia traumática, experimentan un vacío identitario, así como estragos individuales provocados por la falta de la figura paterna. Por otro lado, también se analizan el trauma y el silencio de las madres sobrevivientes como remanente del miedo/terror experimentado durante el conflicto armado, pero también como un mecanismo de protección para sus hijos. An exposition in five parts of the character of existentialist philosophy, including an analysis of the theories of Jean-Paul Sartre. Author Gabriel Marcel, a famous French dramatist, philosopher, and author of Le Dard, was a leading exponent of Christian existentialism.

We argue that not all cases of before-effect involve causation and ask how to demarcate cases of before-effect in which the events that follow exert causal influence over the before-effect from cases in which they do not.

Of course, the rationale of PME is so different from what has been taught in “orthodox” statistics courses for fifty years, that it causes conceptual hangups for many with conventional training. But beginning students have no difficulty with it, for it is just a mathematical model of the natural, common sense way in which anybody does conduct his inferences in problems of everyday life.The difficulties that seem so prominent in the literature today are, therefore, only transient phenomena that will disappear (...) automatically in time. Indeed, this revolution in our attitude toward inference is already an accomplished fact among those concerned with a few specialized applications; with a little familarity in its use its advantages are apparent and it no longer seems strange. It is the idea that inference was once thought to be tied to frequencies in random experiments, that will seem strange to future generations. (shrink)
